Terms and Conditions


1. The Guest or guests shall be entitled to occupy the property for holiday purposes only and this agreement shall not confer upon them any security of tenure within the terms of the Housing (Scotland) Act 1988 pursuant to which the occupation shall be deemed to be by way of an excluded tenancy. The Guest  shall not sub-let the premises or any part thereof.

2. Rental Period:  All bookings start from the date given on the booking confirmation  and the property must be vacated by 10.30 am on the date of departure.

3. When possible, an arrival time should be agreed with the Owners prior to arrival.  If the agreed time is exceeded by more than one hour, the Guest  may have to contact the Owners to re-arrange collection of the keys and may incur an additional charge of £50 in this regard.  It should be noted that the Owners live distant from the property and have a travelling time of 30/40 minutes to allow entry to the apartment.

4. Deposit/Payment. A deposit of 10% of the full rental is payable when booking, unless the booking is made within 6 weeks of the rental commencement date when the full amount is payable. If the full balance is not received  6 weeks prior to the rental commencement date, the deposit will be forfeited and the property re-let.  A formal  reservation confirmation with payment options will be issued following initial agreement.

5. Cancellation. Once a booking deposit has been paid and the booking confirmed in writing/by email, the Guest is liable for the whole amount of the rent for the period booked. The deposit is non-refundable if the booking is cancelled.
Cancellation policy - If the booked period is able to be  re-let, then the rent achieved for the new booking will be refunded (minus any associated costs incurred). This may be less than the original price agreed. Otherwise, the Guest will have to rely on his/her own holiday insurance for reimbursement. All cancellations must be made in writing/by email.

6. Holiday Insurance. Once booked, the Guest  is liable for the full rental and accordingly, it is  recommended that  holiday insurance is obtained to cover unforeseen circumstances necessitating cancellation.

7. Availability. The booking is made on the understanding that the property will be placed at the Guest`s disposal for the agreed dates. Should this not be possible through fire, theft or circumstances beyond the Owner`s control, the full amount paid by the Guest will be refunded. However, please note that:
a. No alternative accommodation can be provided;
b. The Guest will not have any claim against the Owners for compensation or expenses.

8. Maximum/Specified Occupancy. The maximum or contracted occupancy as specified in the  booking confirmation must be adhered to. If this condition is not observed, the Owners reserve the right to refuse admittance or require that the Guest or guests vacate the property. In this eventuality, no refund of monies will be due.

9. Amenities. The use of the property includes electricity, water heating, heating and use of TV.  Bed linen and towels are also included in the rental and must remain within the property.

10. Pets are strictly prohibited.

11. Smoking. This apartment is strictly `no-smoking`. The Guest   may not smoke within the property or allow any member of their party or other invited persons to smoke within the property. Any breach of this restriction will result in the termination of the Guest's booking and a request to vacate immediately. All monies paid will be forfeited. Smoking is permitted in the outside areas of the Property; however the Guest must ensure that all evidence of smoking in the outside areas is removed prior to departure.

12. Cleaning. All equipment, utensils, crockery etc. must be left clean.  The property must also be left in a  clean and tidy condition at the end of the rental period.  The Owners reserve the right to charge for additional cleaning. Note: It is the Guest's responsibility to ensure the safe storage of cleaning materials within the apartment, particularly in the presence of children.

13. Nuisance. The Guest shall not cause  nuisance including noise pollution to neighbouring owners and/or tenants.

14. Right of Entry. The Owners reserve the right to enter the property at any reasonable time, with or without notice, during the Guest's period of stay. In the event of repairs or maintenance being required, normally notice will be given if possible.

15. Damages & Breakages. The Guest undertakes to keep the property and all the furniture, fittings and contents in the same state of repair and condition as at the commencement of the letting. All damage, breakages or equipment failure to the Property or its contents must be reported to the Owners as soon as possible. The Owners will arrange to repair the damage as soon as practical, however there is no guarantee this will be within the period of hire. Damage or breakage caused by act or omission of the Guest or persons attending the property at the Guest's invitation must be repaired or replaced by the Guest at the Guest's expense within 7 days of the cost of repair or replacement being determined and notified to the Guest. The cost of repair or replacement shall generally be determined within 14 days of notification. Any repair or replacement shall be to the original standard. Should the damage result in another booking being cancelled, the Guest will be held liable for all consequential losses to the Owner. All breakages are chargeable.

16. Appliance Breakdown. In the event of a breakdown, the Owner will do everything possible to ensure swift repair/replacement of any appliance provided at the property. However, the Guest must accept that it may be impossible to deal with every eventuality during the course of a booking period. Where a breakdown is determined to be a direct result of misuse, the Guest will be required to cover the full cost of repair or replacement. If an appliance has failed, it may not always be possible for it to be repaired during the holiday let booking period. Also, if a repair is required to an appliance or if any maintenance work is required, entry into the premises will be required.

17. Left Items. The Guest will be notified of any possessions that have been left in the property after it has been vacated. Notice will be given in writing by post or email, generally within fourteen days after the end of the booking period. The Guest must meet the cost of returning any items and the Owners will also levy a charge of £5.00 to cover handling costs. If the Guest does not wish  the item to be returned, the Owners  will dispose of it as necessary but reserves the right to levy a charge for any items which are hazardous or difficult to dispose of. Please note: any items to be returned will be suitably packed but the Owner accepts no responsibility for loss or damage in transit.

18. Security. The Guest is responsible for the security of the property for the duration of the booking period and also immediately after vacation, until such time as the Owners re-enter the Property. The Guest is expected to take all reasonable care of the property which includes ensuring that the property is fully secured when leaving. No windows should be left open and all locks must be secure.
